1. Agreement to Terms

These Terms of Use ("Terms") constitute a legally binding agreement between you and Lingtrio LLC, a Florida limited liability company (EIN: 32-0815936), located at 7901 4th St N, Ste 300, St. Petersburg, FL 33702, United States ("Company", "we", "us", or "our"). By accessing burgerman.org ("Site") or downloading, installing, or using the Burgerman: Burgers & Recipes mobile application ("App"), you agree to be bound by these Terms. If you do not agree, do not use the Site or App.

2. Eligibility

You must be at least 13 years of age to use this Site or App. By using the Site or App, you represent and warrant that you are at least 13 years old and have the legal authority to enter into these Terms. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. License to Use

Subject to these Terms, Lingtrio LLC grants you a limited, non-exclusive, non-transferable, revocable license to access the Site and to download and use the App on a device you own or control, solely for your personal, non-commercial purposes. You may not:

• Copy, modify, or distribute the Site or App or its content
• Reverse engineer or attempt to extract the source code
• Use the Site or App for any unlawful purpose
• Sublicense or resell access to the Site or App
• Use automated tools (bots, scrapers) to extract content

4. In-App Purchases (Mobile App)

The mobile App offers one-time in-app purchases that unlock "Secret Burger" recipe content ("Purchases"). All Purchases are processed through Apple's App Store payment system and are subject to Apple's terms and conditions.

Non-Refundable:All Purchases are final and non-refundable, except as required by applicable law or as permitted by Apple's refund policy. To request a refund, please contact Apple directly through your App Store account.

Restore Purchases:If you reinstall the App or switch devices, you may restore your previous Purchases at no additional cost using the "Restore Purchases" feature within the App.

5. User Accounts

To use certain features (voting, bookmarks, account features), you may create an account via email/password or third-party sign-in (Google, Apple). You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. We reserve the right to suspend or terminate accounts that violate these Terms.

6. User Content and Community Features

The Site and App allow you to submit ratings, votes, and bookmarks for burger content. By submitting ratings, you grant Lingtrio LLC a worldwide, royalty-free license to use, display, and analyze your ratings to improve the Site and App. You agree not to submit false, misleading, or abusive content. We reserve the right to remove any content that violates these Terms.

7. Intellectual Property

All content within the Site and App, including but not limited to burger recipes, descriptions, images, rankings, the "Burgerman" brand, logos, and software, is the exclusive property of Lingtrio LLC or its licensors and is protected by U.S. and international copyright, trademark, and intellectual property laws. You may not reproduce, distribute, or create derivative works from any content without our prior written consent.

8. Advertising

Our Site displays advertisements served through Google AdSense. By using the Site, you acknowledge that advertisements will be displayed and may be personalized based on your browsing behavior (subject to your cookie preferences). We do not endorse the products or services advertised. Any transactions you make with advertisers are solely between you and the advertiser.

9. Prohibited Conduct

You agree not to:

• Use the Site or App in any way that violates applicable U.S. federal, state, or local laws
• Attempt to gain unauthorized access to any portion of the Site/App or related systems
• Interfere with or disrupt the integrity or performance of the Site/App
• Use automated tools to scrape or extract content
• Impersonate any person or entity
• Submit false ratings or attempt to manipulate community ratings

10. Third-Party Services

The Site and App integrate with third-party services including Apple Sign-In, Google Sign-In, YouTube, Supabase, RevenueCat, Google Analytics, Google AdSense, and Vercel. Your use of these services is governed by their respective terms and privacy policies. Lingtrio LLC is not responsible for the content or practices of any third-party services.

11. Disclaimer of Warranties

THE SITE AND APP ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. LINGTRIO LLC DOES NOT WARRANT THAT THE SITE OR APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LINGTRIO LLC AND ITS MEMBERS, OFFICERS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SITE OR APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify, defend, and hold harmless Lingtrio LLC and its members, officers, agents, and successors from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site or App, your violation of these Terms, or your violation of any third-party rights.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of the Site or App shall be resolved exclusively in the state or federal courts located in Pinellas County, Florida. You hereby consent to personal jurisdiction in such courts.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last Updated" date. Your continued use of the Site or App after any changes constitutes your acceptance of the revised Terms.

16. Termination

We reserve the right to suspend or terminate your access to the Site or App at any time, with or without cause, and with or without notice. Upon termination, your license to use the Site or App will immediately cease. Sections 7, 11, 12, 13, and 14 shall survive termination.
